Separation
Separation arises where there is no reasonable prospect of the parties reconciling. Separation can arise even when parties are living under the one roof although it may be more difficult to prove.
To apply for divorce, you have to be separated from your former partner for at least 12 months. Attempts to reconcile during the 12 month period may either extend the period, or cause it to recommence, depending on the number of times the parties have endeavoured to reconcile.
